You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Payment Terms
Payment terms are agreed upon before project commencement. A deposit may be required for new projects. Final payment is due upon project completion unless otherwise specified in your service agreement.
5. Intellectual Property
Upon full payment, clients receive ownership of custom code and designs created specifically for their project. We retain the right to use non-confidential aspects of our work in our portfolio.
6. Limitation of Liability
West Indian Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our liability is limited to the amount paid for the specific service.
7. Hosting and Maintenance
Hosting services are provided on a subscription basis. We guarantee 99.9% uptime for our hosted services. Maintenance and updates are performed during off-peak hours when possible.
8. Termination
Either party may terminate services with 30 days written notice. Upon termination, you are responsible for any outstanding payments. We will provide reasonable assistance in transferring your data.
9. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms will be resolved through arbitration or in the appropriate courts.
10. Changes to Terms
We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
